Dr. Medard M.C.Kalemani
Dr. Medard M.C.Kalemani is a Director of Legal Services
of the Ministry of Energy and Minerals of the Government of the United Republic
of Tanzania. He holds a Doctorate Degree
(PhD) in Mining Management with specific Reference to “Legal, Policy, Administration
and Institutional Framework of Mining Industry” a case study of Developing
Countries Tanzania, South Africa, Ghana and Botswana (2006); with a Master Degree of
Laws (LL.M) in Mineral Law and Policy, University of Dundee- Scotland, UK, 2002
with specialization in;- Mineral Resources Policy and Economics,
Economics of Natural Resources Law, International Law of Natural Resources,
Mineral and Petroleum Taxation, Environmental Law and Policy for Natural
Resources & Energy, International
Environmental Law; and Mineral law and Policy.
Dr. Kalemani, holds a Bachelor Degree of Laws
(LL.B-Hons), University of Dar es Salaam (UDSM) (1996) with specialization in:-
Contract Law, Labour Law, Company Law, Criminal law and Procedures, Civil Procedure, Law of Taxation, Land Law, Law of Evidence,
Legal Method, Jurisprudence and Commercial Law.
Dr. Kalemani attended various International Contracts
Training Courses on “Management of Claims and Dispute Resolution of large works
Contracts and Agreements, Construction Industries and investments” –FIDIC
Training Program in different countries
including in Accra, Ghana (July 2010) and Swaziland (2005).
He also attended
significant trainings on “Global issues in Corporate Mining Strategy and
Government Policy” both in Africa and in the
UK, between 2000 and 2001.
As a Director of Legal Services, his roles include
overseeing all legal issues under the Ministry and of the relevant Institutions
under the Ministry, overseeing and supervising all legal issues relating to
energy and mineral resources in the country. Coordinating negotiations and
liaising with the Office of the Attorney General’s Chambers and other
Government Institutions on legal issues of the energy and minerals sectors.
Dr. Kalemani worked as General Counsel and Chief Legal
Counsel of the Millennium Challenge Account-Tanzania
(MCA-Tanzania) funded by the Government of the United States of America through
Millennium Challenge Corporation (MCC) for the last seven years. As General
Counsel, his key role included Overseeing, supervising and managing MCC funded
programs for development of transportation, energy and water infrastructures in
Tanzania. He managed more than 200 large works and Consultancy Service
contracts; and more than 400 medium
and small scale suppliers and service providers’ contracts for the period of 7
years from December 2007.
Since April, 1999
to November, 2007, Dr. Kalemani worked as State Attorney and later as A Senior
State Attorney under the Ministry of Energy
and Minerals and from May, 1997 to December, 1998 was employed by the
International Rescue Committee (IRC), a Relief Agency under the UNHCR, as Legal
Manager/ Office Manager and in charge of local staff for the Tanzania Branch.
Dr. Kaleamni is a Registered and Practicing Advocate of
the High Court of Tanzania and Subordinate Courts thereto. In 2004 and 2005
worked with the United Nations Economic
Commission for Africa (UNECA) as an International Legal Expert of the
International Study Group based in Lusaka-Zambia. The key role of the Group was
to review Mining Regime including the Mining Policies and Legal Framework of
the Developing Countries.
August, 2004, Dr.
Kalemani was appointed by the United
Nations Development Program (UNDP) Vienna-Austria as a National Legal Expert in
Tanzania to undertake a study and establish an appropriate Legal and Regulatory
Framework of “Mercury application by Small scale mining in Tanzania with
specific reference to Botswana, Tanzania, India and Lao’s Peoples’ Republic”
with UNIDO/under GEF Project operated by the Ministry of Energy and Minerals in
Tanzania from 1st August to 30th October, 2004.
In, 2002, Dr.
Kalemani wrote and published a “Comparative Study of Mineral Laws, Regulatory
Framework and Mineral Rights Administration in Developing Countries; A case
Study of Tanzania, South Africa, Namibia and Botswana”. A report was submitted
through a Partial fulfilment of Masters Degree in Mineral Law and Policy
(LL.M), -Scotland in July, 2002.
In May 2001, He
was appointed as an Independent Consultant to the review Process of the
Minerals Act of the Republic of South Africa, Act No. 50 of 1991, which was
passed by the Parliament of the Republic of South Africa in 2002 and Published
in the Government Gazette of the Republic of South Africa in June, 2002.
In 2001, he
participated in the review process of the Mining Act No. 5 of 1998, of the
United Republic of Tanzania (Published in the Government Gazette GN No.
217
From March –
August, 1999, he participated in the Review of the Mining (Mineral Trading)
Regulations, 1999, which was Published in the Government Gazette No. 215 of
July, 1999.
Dr. Kalemani was born in Tanzania in 1968 and he is
fluent in Kiswahili, English and French, with Computer literacy in Microsoft
Words, Access and Windows and Microsoft Management.
